Recognition of the denomination of origin checked of the wines "Capalbio" and approval of the relative disciplinary of production.
The Executive head of the administrative section of the national Committee for the guardianship and the exploitation of the denominations of origin and the geographical indications typical of the wines and person responsible of the procedure; Seen the decree of the President of the Republic July 12 th 1963, n.930, container the norms for the guardianship of the denominations of origin of the wines; Sees the law February 10 th 1992, n. 164, bringing new discipline of the denominations of origin of the wines; Seen the decree of the President of the Republic April 20 th 1994, n.348, with which and' is emanated the rule bringing discipline of the procedure of recognition of the denominations of origin of the wines; Sees the decrees of realization, till now emanated, of the aforesaid law; Sees the law June 16 th 1998, n. 193 bringing change to the art. 7 of the law February 10 th 1992, n. 164; Sees the understood question to get the recognition of the denomination of checked origin "Capalbio", introduced by the provincial Federation Coldiretti of Grosseto, from the Confederation Italian agriculturists of Grosseto and from the Confagricoltura union provincial agriculturists of Grosseto, done proper from the provincial administration of Grosseto and equipped by the opinion of the region Tuscany; Sees the favorable opinion of the national Committee for the guardianship and the exploitation of the denominations of origin and the geographical indications typical of the wines on her above suitable question and the proposal of the relative disciplinary of production of the denomination wines of checked origin "Capalbio", published in the Official Gazette n. 63 of March 17 th 1999; Held therefore necessary to owe him to proceed to the recognition of the denomination of checked origin "Capalbio" and to the approval of the relative disciplinary of production of the wines in matter, in conformity' to the express opinion and the proposal formulated by the sopracitato Committee; Considered that 1'art. 4 of the rule April 20 th 1994, n. 348, pertaining to the procedure for the recognition of the denominations of origin and the approval of the disciplinary ones of production, foresees that the disciplinary ones of production are approved and recognized with decree of the executive responsible of the procedure; It decrees:
Art. 1.
The denomination of checked origin is recognized "Capalbio" and and' approved, in the attached text to the present decree, the relative disciplinary of production. The denomination of checked origin "Capalbio" and' reserved to the wines that answer to the conditions and the established requisite in the disciplinary one of production of which to the paragraph 1 of the present article whose norms go into effect to elapse from the vintage 1999.
Art. 2.
The subjects that intend to set in commerce, beginning from the vintage 1999, the wines with the denomination of checked origin "Capalbio", they are kept to effect the report of the respective terrestrial vitati, within sixty days from the date of publication of the present decree, to the senses and for the effects of the art. 15 of the law February 10 th 1992, n. 164, bringing norms related to the bulletin-board of the vineyards and to the report of the grapes.
Art. 3.
The vineyards reported to the senses of the preceding art. 2, only for the year 1999, can be enrolled to provisional title,
in the anticipated bulletin-board from the art. 15 of the law February 10 th 1992, n.164, if, in opinion of the technical organs of the region Tuscany, sufficiently results documented, also not having been effected yet, for impossibility' technique, the checks of
fitness' anticipated from the normative in force.
Art. 4.
You/they can be enrolled to the bulletin-board of the vineyards, for a three year-old maximum period beginning from the vintage 1999, also the
surfaces vitate in whose aspired they are different present grapevines of vines from those suitable in the article 2 of the united disciplinary of
production provided that' the presence, in the said vineyards, of different grapevines from those anticipated from the aforesaid art. 2, don't result to be superior to the 20% of the total one of the basic same ampelografica, in conformity' of the actual dispositions of the normative U.Es.
To expire some aforesaid transitory period, the vineyards of which will be cancelled of office by the respective bulletin-board to the preceding paragraph, if the interested producers have not provided to introduce, to said vineyards, the necessary changes to conform their composition ampelografica to the dispositions of which to the art. 2 of the attached disciplinary of production, giving immediate communication of it to the competent office of the regional assessorato to the agriculture, to the goals of the execution of the technical checks of fitness.' The vineyards of which to the preceding paragraph, that following the execution of the technical checks, doesn't result conforming to the united disciplinary, is cancelled of office by the relative bulletin-board.
Art. 5.
Whoever produces, he/she sells, it sets in sale or however it distributes for the consumption wines with the denomination of checked origin "Capalbio" and' kept, to norm of law, to the observance of the conditions and the established requisite in the attached disciplinary.
The present decree will be' published in the Official Gazette of the Italian Republic.

DISCIPLINARY OF PRODUCTION OF THE WINES
TO DENOMINATION OF CHECKED ORIGIN "CAPALBIO"
Art. 1.
The denomination of checked origin "Capalbio" and' reserved to the wines that answer to the conditions and the requisite established by the disciplinary present of production for the following typologies: red (also in the typology it reserves), white, rosy, Vermentino, Sangiovese, Cabernet Sauvignon and Vin Santo.
Art. 2.
The wines of which to the art. 1 must be get from the grapes produced from the having vineyards, in the business circle, the following composition ampelografica:
- "Capalbio" red, rosy and red reserve: Least Sangiovese 50%. For the general remainder you/they can compete berry grapes black, not aromatic, gotten by recommended vines authorized e/o in the province of Grosseto.
- "Capalbio" white and Vin Santo: They thresh least Tuscan 50%. For the general remainder you/they can compete to the production berry grapes white, not aromatic, gotten by the recommended vines authorized e/o in the province of Grosseto.
- "Capalbio" Vermentino: wine must be gets from grapes produced from the vineyards composed by the vine Vermentino for at least him 85%. You/they can compete to the production of motto wine, thin to a maximum of 15%, the berry grapes white, not aromatic, gotten by the recommended vines authorized e/o in the province of Grosseto.
- "Capalbio" Sangiovese: wine must be gets from grapes produced from the vineyards composed by the vine Sangiovese for at least him 85%. You/they can compete to the production of motto wine, thin to a maximum of 15%, the berry grapes black, not aromatic, gotten by recommended vines authorized e/o in the province of Grosseto.
- "Capalbio" Cabernet Sauvignon: wine must be gets from grapes produced from the vineyards composed by the vine Cabernet Sauvignon for at least him 85%. You/they can compete to the production of motto wine, thin to a maximum of 15%, the berry grapes black, not aromatic, gotten by recommended vines authorized e/o in the province of Grosseto.
Art. 3.
The zone of production of the fit grapes to the production of the denomination wines of checked origin "Capalbio", it reverts in the hilly zone and pedecollinare of the south area of the province of Grosseto and he/she understands part of the administrative territories of the communes of Capalbio, Manciano, Magliano and Orbetello. The line of delimitation begins to South from the point of meeting of the town border of the commune of Capalbio with the railroad Grosseto-Rome and goes up again (in sense hourly anti) to East and therefore to North long said town border, enters then the commune of Manciano following the road of reclamation n. 28 thin to introduce him, in the place' Sgrillozzo, on the government road n. 74, that it crosses up to the curve of house Poggio Lepraio; it continues then with the road of reclamation n. 19, that it passes for Casalnuovo and house Pinzuto and therefore with the road of reclamation n. 17, passing for house of the Loose one up to the river Albegna. From here the border it follows the course of the river Albegna up to the ford of the Marianaccia, diverting to West, it enters the commune of Magliano in Tuscany, it crosses the road of Hill Wolf up to the Grinds Old, it goes up again to Northeast for the road of S. Andrew to the Civilesco, comes down toward South along the road Magliano in Tuscany-boat of the you Pardon, you/he/she diverts to West for the road of the you/he/she dares and you/he/she continues along the town limit of Magliano in Tuscany until to meet the railroad Grosseto-Rome in proximity' of the Farm of the Collecchio, you/he/she follows said railroad toward thin South to meet the SP 81 in proximity' some river Dares and actually crosses her/it to go beyond the farm n. 39 and it diverts southeast along the road that brings to S. Given center. It revolves counterclockwise part of the center in sense and it continues in direction Southwest along the road that coasts along the farms n. 23, n. 24 and n. 20 and it is introduced on the SP 56 in proximity' of the farm n. 26 passing for S. Donato and it actually crosses her/it to the bridge on the river Albegna in proximity' some Boat of the Pardons; it follows therefore the course of the river going up again him/it up to the agricultural center of the Alberone, it goes down toward South along the road interpoderale that conducts to the SS 74 maremmanas, it is introduced on it directing himself/herself/itself toward the coast thin tirrenica to cross the line railway Grosseto-Rome that actually crosses to the point of departure.
Art. 4.
The environmental conditions and colturali of the vineyards destined wines of checked origin to the production of the denomination
"Capalbio" you/they must be those traditional of the zone and however such to confer to the grapes and the derived wines the specific characteristics of quality.' The vineyards are excluded leading valley, in clays plioceniche, in the zones golenali or however in damp grounds or that they lack of suitable setup idraulicoagraria. I am therefore to consider him fit, to the goals of the registration to the bulletin-board of which to the art.15 of the law February 10 th 1992, n. 164, entirely the inclusive vineyards in the hilly band and pedecollinare.
For the new fittingses and the reimpiantis the density' average of the fetterses is not able' to be inferior to 3.300 plants for hectare.
The grapes coming from enrolled vineyards to the bulletin-board of the denomination of checked origin "Capalbio" you/they can be destined wines of checked origin to the production of the denomination "Capalbio" Vin Santo, if the interested producers opt for such claims in center of annual report of the grapes done to the competent room of commerce.
The orders of plant, the forms of breeding and the systems of pruning must be those traditional of the zone (back
simple and cord speronato) and, however, fit not to modify the characteristics of the grapes and the wine. The orders of plant are suitable to the forms of breeding. The region is able' to allow other forms of breeding if is such to be improved the management of the vineyards without determining negative effects on the characteristics of the grapes.
And' forbidden every practice of forcing. And' allowed the irrigation of help.

To such limits, also in favorable years exceptionally, the surrender will owe' to be brought in the limits of which above provided that' the global production doesn't overcome of 20% the limits themselves, firm staying the limits made grape / wine for the quantities of which drawn aside himself/herself/themselves.
Locks staying the limits of which above, the surrender for hectare of the promiscuous crop must be calculates, in comparison to that specialized, in relationship to the real surface covered by the grapevine.
Art. 5.
The operations of vinificazione, and of obligatory aging of the denomination wines of checked origin "Capalbio" you/they must have effected within the zone of production of which to the art. 3. The imbottigliamento must have effected within the administrative territory of the province of Grosseto.
And' allowed the correction of the musts and the wines of which to the art. l, in the limits established by the community and national norms with assembled musts gotten from grapes of the enrolled vineyards to the bulletin-board of the same denomination of checked origin or with must assembled corrected and to half concentration to cold or other allowed technologies.
The typology "Capalbio" rosy you/he/she must be gets with the vinificazione "in rosy" of the red grapes.
In the wines' vinificazione to D.O.C. "Capalbio" the practical fit local, loyal and constant enologiches are admitted only to
to confer to the wines medesinii theirs peculiar characteristics. The maximum surrender of the grape in wine must not be superior for the
denomination wines of checked origin "Capalbio" red, "Capalbio" red reserve, "Capalbio" Sangiovese, "Capalbio" Cabernet Sauvignon, "Capalbio" rosy, "Capalbio" white and "Capalbio" Vermentino to 70%, if such surrender overcomes the percentage above suitable but not over 75%, the excess won't have' right to the denomination of checked origin "Capalbio"; over said limit percentage decays the right to the D.O.C. for the whole product. For the typology "Capalbio" red reserve and' obligatory the aging than at least 2 years, of which 6 months least in wood strokes and the immission to the consumption it is not able' to happen before the 1 of June of the third following year to that of production of the grapes. For the typologies "Capalbio" Sangiovese, and "Capalbio" Cabernet Sauvignon the immission to the consumption is not able' to happen before 1 March of the following year to that of production of the grapes. For the typologies "Capalbio" rosy, "Capalbio" white and "Capalbio" Vermentino the immission to the consumption is not able' to happen before 31 December of the year of production of the grapes.
For the production of the typology "Capalbio" Vin Santo the method of vinificazione foresees how much it follows:
the grape, after having suffered an accurate selection, you/he/she must have submitted to withering and it is able' to be not ammostata before 1 December of the year of harvest and not over 31 March of the following year; the partial withering of the grapes must happen in local fit, and and' also admitted a partial dehydration with ventilated air, up to reach not an inferior sugary content to 26,6%; the maintenance and the aging must have effected in wood (caratelli) containers of it persuades' not superior to 3 Hls for a period than at least two years; for the denomination wine of checked origin "Capalbio" Vin Santo the maximum surrender of the grape in wine must not be superior to the 35% of the fresh grape a third year of aging of the wine; the immission to the consumption is not able' to happen before 1 November of the third following year to that of production of the grapes.
Art. 6.
The denomination wines of checked origin "Capalbio" to the action of the immission to the consumption you/they must answer to the followings
characteristics:
"Capalbio" red:
- color: red ruby more' or less intense;
- odor: wine characteristic;
- taste: harmonic, dry, justly tannico;
- title alcolometrico least total volumico: 11,00% vol.;
- acidity' total least: 5,0 g/ls;
- extract dry clean minimum: 20,0 g/ls.
"Capalbio" Sangiovese:
- color: red ruby more' or less intense;
- odor: ample, wine;
- taste: full, dry, justly tannico;
- title alcolometrico least total volumico: 12,00% vol.;
- acidity' total least: 5,0 g/ls;
- extract dry clean minimum: 22,0 g/ls.
"Capalbio" rosy:
- color: gnawed more' or less intense;
- odor: wine, yielded, fresh;
- taste: dry, yielded, characteristic;
- title alcolometrico least total volumico: 10,50% vol.;
- acidity' total least: 5,0 g/ls;
- extract dry clean minimum: 16,0 g/ls.
"Capalbio" Cabernet Sauvignon:
- color: red sometimes with purplish reflexes;
- odor: wine with known typical speziate;
- taste: full-bodied, dry, savory, justly tannico;
- title alcolometrico least total volumico: 12,00% vol.;
- acidity' total least: 5,0 g/ls;
- clean dry extract mimmo: 22,0 g/ls.
"Capalbio" red reserve:
- color: red ruby more' or less intense extending to the pomegranate with the aging;
- odor: ample, wine;
- taste: harmonic, dry, savory, justly tannico;
- title alcolometrico least total volumico: 12,00% vol.;
- acidity' total least: 5,0 g/ls;
- extract dry clean minimum: 22,0 g/ls.
"Capalbio" white:
- color: yellow pale yellow unloaded;
- odor: delicate, fresh, yielded;
- taste: dry;
- title alcolometrico least total volumico: 10,50% vol.;
- acidity' total least: 5,0 g/ls;
- extract dry clean minimum: 15,0 g/ls.
"Capalbio" Vermentino:
- color: yellow pale yellow more' or less intense, sometimes with greenish reflexes;
- odor: delicate, characteristic and yielded;
- taste: dry, savory;
- title alcolometrico least total volumico: 11,00% vol.;
- acidity' total least: 5,00 g/ls;
- extract dry clean minimum: 15,0 g/ls.
"Capalbio" Vin Santo:
- color: from the gilded yellow up to the intense ambrato;
- perfume: ethereal, intense and characteristic;
- taste: harmonic, velvety, round;
- title alcolometrico least total volumico for the dry type: 16,00% vol. of which maximum 2 to be developed;
- title alcolometrico least total volumico for the agreeable type: degrees 16,00% vol. of which from 3 to 6 to be developed;
- acidity' total least: 5,0 g/ls;
- least dry extract: 21,0 g/ls;
- acidity' volatile motto: 1,60 g/ls.
It is' faculty' of the Office for the agricultural politics - national Committee for the guardianship and the exploitation of the denominations of
origin and of the geographical indications typical of the wines, to modify, with really decree, the limits of the acidity' total and of the extract
dry clean. In relationship to the possible maintenance in wood containers, where allowed, the taste of the wines is able' to notice light wood sign.
Art. 7.
In the etichettatura, designation and presentation of the wines of which to the art. 1 and' forbidden the addition of any different qualification
from those anticipated from the disciplinary present of production understood ivi the extra adjectives, end, select, selected and similar.
And' nevertheless the use of indications that reveals names reference, social reasons and marks deprived not having meaning allowed
laudatory and not fit to deceive the consumer.The indications extending to specify the activity' agricultural of the bottler what wine-grower, farm, estate, farm, farmhouse and other similar terms are allowed observance of the dispositions UE and national in subject. And' also allowed' the use of indications that makes communes reference, fractions, areas, zones and place' inclusive in the zone delimited in the preceding art. 3 and from which indeed grapes originate from which the wine, so' qualified, and' gets, to the anticipated conditions from the decrees ministerial 22 April 1992 and from following changes or integrations. For the typologies "Capalbio" reserve, and "Capalbio" Vin Santo, in label, you/he/she must obligatorily show up the indication of the year of production of the grapes.
Art. 8.
The wines of which to the art. l can be introduced only to the consumption in containers of glass of nominal volume up to 5 liters to
exception of the typologies "Capalbio" Vin Santo and "Capalbio" red reserve, for which bottles are allowed only of it persuades' nominal not superior to 0,750 lts.
